Lawful Stay and Work in Türkiye for Turkmen Nationals: From Visa to Work Permit

1. Do Turkmen nationals need a visa?

Entry into Türkiye, residence in Türkiye and work in Türkiye are three separate legal stages. The first is particularly important for Turkmen nationals: the visa exemption previously applied to tourist visits with ordinary passports has been abolished. Relying on past travel experience, starting work based on an employer’s verbal promise or postponing an expired-passport issue may cause consequences that are difficult to resolve later.

2. Check passports and identity documents early

Turkmen nationals holding ordinary passports are subject to a visa requirement when travelling to Türkiye. The current country list of the Ministry of Foreign Affairs states this rule. A consular notice dated 14 September 2022 says that the former tourist exemption was abolished by Presidential Decision No. 6034 of 13 September 2022. Any exemption for official passport holders must be assessed separately.

Being subject to a visa does not mean every application results in the same visa type or permitted stay. State the actual purpose—tourism, work or study—and distinguish the visa validity dates, number of entries and permitted duration of stay. A visa that can be used for entry over several months does not necessarily allow the holder to spend all those months in Türkiye; check the stay limit stated on the document.

Check any e-Visa option through the current official system; do not assume that every Turkmen national automatically qualifies. A visa also does not absolutely guarantee admission: passport validity, entry restrictions and the purpose of travel may be reviewed at the border. An air ticket or employment contract does not remove that review.

3. Residence permits: apply for the genuine purpose

A valid passport or accepted travel document is important when residence and work permits are issued. An expired document, lost passport, names transliterated differently or inconsistencies in civil-status records may delay an application. Do not assume that a passport extension or other procedure by a foreign authority will automatically be accepted by Turkish authorities; confirm acceptance with the relevant authority.

As a practical step, keep the passport identity page, used pages, visas and entry records together. Explain differences in spelling across documents and do not use identity details that are not true. Delays in consular procedures do not automatically extend lawful stay. Document the delay and assess its effect on the person’s current status in time.

4. Should a work permit be requested in Türkiye or from abroad?

Anyone wishing to stay longer than the period allowed by a visa should identify the appropriate residence or work-permit route before lawful stay expires. Genuine education matters for a student; family ties and sponsor conditions matter for family residence; a credible stay plan and supporting documents matter for tourism. Law No. 6458 provides different permit categories for different circumstances. Choosing the category that appears easiest to apply for is not enough.

A lease may be one required document, but it does not itself grant residence. Verify the actual address, use of the dwelling and whether applications are accepted for that address. Falsely showing another person’s address can undermine the reliability of documents and statements. After a permit is granted, its purpose and address obligations continue to matter.

Keep application records distinct: appointment confirmation, application form, official application document and residence card have different legal functions. Travel abroad and return should be checked against the particular document held. A visa-required person should not plan travel on the assumption “I applied for residence, so I can return whenever I want.”

5. Not every job offer qualifies for a permit

Under the Ministry of Labour’s current guidance, an in-country application is generally made by the employer for a foreign national who holds a valid residence permit issued for at least six months as of the application date. This should not be read as a requirement to have physically lived in Türkiye for six months. Check the permit type, validity and any exceptional application category.

A person who does not meet the in-country conditions should consider applying from abroad. Under the official guide, the foreign national applies at a Turkish mission in the country where they are lawfully present and gives the employer in Türkiye the 16-digit reference number. The employer must complete the online application within the 30-day period stated in the guide. The consular application and employer procedure are linked.

The employer must genuinely be able to submit the application. Creating an account, uploading documents or paying a fee is not an approval. Starting work while the process is pending does not generally create a right to work. The employee should obtain a copy of the application and decision made in their name rather than relying on unverifiable promises by intermediaries.

6. Is it true that “Turkic-origin” nationals do not need a permit?

The assessment may consider the employer’s financial capacity, workforce, nature of the role, the foreign national’s qualifications and wage conditions. General criteria and sector- or occupation-specific exceptions may apply. Merely finding an employer does not mean the application will be approved. The authorized role must match the work actually performed.

For domestic services, the relevant categories focus on childcare, care for a person with a disability or an older person, and patient companionship. A vague description such as “household work” does not explain a care or companionship need. The employer, relationship to the person receiving care and income documents may also be assessed. This is not a generalization about what occupations Turkmen nationals perform; it explains the correct application category for anyone seeking such work.

When a permit is issued, check the employer, role and validity period. Do not assume it can be used to work for a different employer. A change of employer, extension or termination may require a new procedure or notification. Work-permit and social-security obligations must be handled together: social-security registration does not replace a permit, and a permit does not replace social-security reporting.

7. Refusal, violations and deportation risk

Turkmen nationality and the special legal status provided for “Turkic-origin” foreign nationals are not the same concept. Ministry explanations refer to a separate assessment under Law No. 2527. Claiming ancestry or cultural affinity does not itself create an exemption certificate from work-permit requirements. The conditions and required determinations for that special regime must be checked for the individual.

The same applies when an employer says, “Turkmen nationals do not need a permit.” Unless a legal basis or valid document is identified, that statement does not provide a safe basis for work. Specify the exact exception, its legal source and the document showing that the person falls within it. Cultural descriptions must not be confused with administrative status.

Practical conclusion

Working without a work permit may lead to sanctions under Law No. 6735 and a deportation assessment under Law No. 6458. Finding a violation does not remove the obligation to consider non-refoulement and individual protective circumstances. A refusal of a work permit, refusal of residence and a deportation decision are separate acts, each with its own remedy.

A deportation decision may be challenged in administrative court within seven days of notification. An administrative-detention decision at a removal centre is challenged separately before the criminal judgeship of peace. One application does not replace the other. Waiting for an employer or intermediary to respond may cause harmful delay.

Payment of amounts due on departure does not always remove an entry ban. The duration of the violation, how it was detected, the manner of departure and any other entry restriction must be considered together. The official entry-ban categories help assess the individual file; they should not be used to promise a fixed penalty or guaranteed return date.
