1. First question in a property purchase: are the buyer and property eligible?
The fact that a property may be sold to a foreign national does not, by itself, show that the buyer can obtain residence at that address or acquire citizenship. Title procedures concern ownership; residence procedures concern staying in Türkiye; citizenship procedures concern a nationality bond with the state. Neighbourhood and area measures adopted because of foreign-population density must be analysed according to which procedure they affect. Relying only on an estate listing that says “residence eligible” hides these distinctions.
2. Review of title, use and contract
Article 35 of Land Registry Law No. 2644 governs acquisition by foreign individuals within statutory limits and for nationals of countries whose acquisition is permitted. The President may impose limits based on country, person, area, type or quantity. It is therefore inaccurate to say that every foreign national has an unlimited right to acquire every type of property anywhere in Türkiye.
The general limits include 30 hectares per person nationwide and a restriction on foreign acquisitions exceeding 10% of the privately owned area in a district. These are not foreign-population ratios used in residence applications. The 10% measure concerns district area subject to private ownership, not population or provincial area. Presidential powers to increase or restrict limits and special rules remain applicable.
Military or security zones and restrictions under special legislation must also be checked. Acquisition by a foreign individual and by a Turkish company with foreign capital are not governed by identical regimes. Incorporating a company should not be presented as a way to eliminate all restrictions. Buyer status, property type and location must be considered together.
3. Requirements for short-term residence through property
First confirm that the registered owner and independent-unit details match the property shown. Examine the effects of mortgages, attachments, usufruct and other annotations, zoning and construction status, and actual use by a tenant or third party. An official parcel query provides basic location data but does not reveal every legal risk. Review should not be limited to documents supplied by the seller.
A promise-of-sale agreement or private preliminary contract does not itself transfer ownership. Clarify who receives payment, the conditions for title transfer and the refund mechanism if completion fails. If residence or citizenship is intended, specify which documents are required and who is responsible for obtaining them. A vague promise that “all permits will be secured” does not remove the administration’s discretion.
Contract review and immigration-permit review should be undertaken together. A contract that is valid under private law does not establish that the expected immigration status will be granted. Ownership may continue even if residence eligibility is unavailable; a person may own a home but be unable to live there continuously. Account for this possibility before payment.
4. What is a closed neighbourhood?
Article 31(1)(b) of Law No. 6458 allows a short-term residence permit to be issued to a foreigner who owns property. Migration Management states that the property must be a dwelling and used for that purpose. Ownership and the genuine basis for residence are therefore examined together. Buying only vacant land or a workplace does not satisfy the residence-through-housing requirement.
Supporting documents for the purpose of stay, suitable accommodation, address information and the other application requirements are assessed. For family members, ownership rights in the property and the family-residence route must be considered separately. One family member’s title does not automatically entitle everyone to the same residence permit. Consistency between the home where the applicant lives and the property relied on for the application also matters.
Administrative guidance points to a value threshold equivalent to USD 200,000 for dwellings acquired on or after 16 October 2023. Information published by Dural Hukuk and Kula Hukuk reflects this main threshold. Its legal nature and scope must be distinguished carefully: it is not the USD 400,000 citizenship threshold and is not expressly written into Article 31 of Law No. 6458.
For the specific file, confirm with the Provincial Migration Directorate the applicable value by purchase date, the amount recorded in the title, the exchange-rate date and transitional treatment of earlier acquisitions. Combining online statements from different periods to promise “residence for the lowest price” is unsafe. Do not assume that a practice said to apply to an earlier owner also applies to a new buyer.
5. A closed neighbourhood is not a prohibited-sale zone
A notice of the Presidency of Migration Management dated 30 June 2022 closed specified neighbourhoods to certain registration and residence procedures due to foreign-population density. It said the number of closed neighbourhoods would rise to 1,169 from 1 July 2022. A Trabzon provincial notice dated 2 July 2022 confirms that historical implementation. These are central and provincial notices from the same administration, not two independent current surveys.
The date of the figure and list must be preserved. A 2022 list alone does not establish the status of every address in 2026. A new application, international or temporary-protection registration, change of province and continuation of an existing status are different procedures. “Closed” is not meaningful unless the affected procedure is identified.
The notice’s exceptions for newborns and nuclear-family reunification should not be read as unlimited exemptions for every residence category. Eligibility depends on documented family ties and the conditions of the particular procedure. If an exception is claimed, request an assessment using the exact address, existing permit and application type. A neighbour’s or previous owner’s successful application does not guarantee the same result.
6. Legal review of a refusal
Restrictions on address/residence procedures due to foreign-population density and prohibitions on property acquisition under the Land Registry Law are different legal mechanisms. One concerns where a foreign national may reside and their status; the other concerns ownership. Thus, “the title was transferred, so there is no neighbourhood issue” is incorrect. The reverse is also true: closing some residence procedures in a neighbourhood does not automatically prohibit all sales there to foreigners.
Before purchase, obtain separate answers: can this person acquire this property, and can the intended residence procedure be made for this address? The title process cannot replace the migration assessment. Use province, district, neighbourhood, street and independent-unit details instead of relying only on a neighbourhood name.
7. If citizenship by investment is planned
If a residence application is refused, review the reasons and the stated remedy. Do not rely on a verbal statement that “the neighbourhood is closed”; identify the rule applied, application date and why any claimed exception was rejected. Earlier permits, family ties, a child’s circumstances and actual use of the address may be submitted according to the case. The same result cannot be promised in every application.
A lawsuit against refusal of residence does not itself produce a residence permit. If a separate deportation decision has been issued, its own judicial route and deadline must also be followed. The seven-day period for challenging deportation is not one general deadline for every residence dispute. An information request or oral discussion with the administration does not replace a judicial application.
The legal review may consider statutory authority, reasons, proportionality and the individual’s circumstances together. However, ownership does not create an unlimited right for a foreign national to remain in the country. Equally, administrative authority does not mean an individual decision is free from reasons or review. Frame the dispute without conflating these areas.
Practical conclusion
Exceptional citizenship through property has separate price and annotation requirements: at least USD 400,000 or equivalent foreign currency, a three-year undertaking not to sell, and a property meeting the Regulation’s definition. TKGM and the Civil Registration Directorate support this distinction. The monetary threshold alone does not guarantee citizenship or residence at every address.
Do not confuse the residence permit used in an investment process with ordinary residence based on property. Plan how the residence address will be established while sale and investment eligibility are checked. If an exception to a closed-neighbourhood rule is claimed, confirm case by case whether it applies to the investment status. General sales language cannot replace review of the individual file.
